For patents, the greater the exclusivity the greater the value
Aside from demand, the key to the value of a patent is its exclusivity, and the extent or magnitude of exclusivity can be affected early on in the innovation process. Valuators should take a look at what transpired before a patent was granted as well as the characteristics of and transactions for an existing patent: [...]
How can an early-stage, zero revenue company be worth more than a stable earner?
Writing to business owners, Susan Schreter in FoxBusiness asks, “Why is it that an unprofitable, research stage technology company with no revenues can be worth millions more than a stable service or manufacturing business with several years of revenues and profits?” She answers her own question by listing six fundamental factors that influence the value [...]
Do directors have the incentive they need to be fully informed about an organization’s IP strategies?
Ian McClure writes about director liability for mismanagement of IP assets. It’s an interesting topic, one that is gaining momentum, but one that seems to suffer from a perverse logic. As more boards have to consider the financial effects of business strategies integrating home grown and acquired IP, and accurate, fair value accounting is expected [...]

Biomedicals and consumers alike await a crucial Supreme Court decision on patentability of diagnostic methods
Yesterday’s argument before the U.S. Supreme Court in Mayo Collaborative Services et al v. Prometheus Laboratories Inc. (No. 10-1150) is the last step before the court (presumably) decides if medical diagnostic processes (instructions for observing changes in a patient relative to a drug’s dosages) are eligible for patent protection. It’s only by first valuing IP assets that they can be managed
Upon the launch of BVR’s new IP Management & Valuation reporter, we asked Mike Moberly to expound on his ideas on valuation of intangibles in today’s world… “If it can’t be measured, it can’t be managed,” an axiom attributed to Peter Drucker and several others, carries as much relevance today as when it was initially [...]
